Receiving a Denial

If you received a denial letter from Social Security for disability benefits as a result of your application, don’t be discouraged. According to a recent Social Security Administration study performed from 2010 to 2019, over 80% of all applications are denied at the initial application level.


Unfortunately, most people, once they receive their denial letter, lose hope of obtaining benefits they may deserve and abandon any further effort. It is estimated that, of the people that are denied, only about 30% of those people use the appeal process that is allowed by the Social Security Administration.

 

For the people that take advantage of the appeals process, well over half of those initially denied eventually receive disability benefits.

 

There are multiple appeal options. Some of those options include:

 

  • Reconsideration

  • Hearing in front of an Administrative Law Judge

  • Review by the Social Security Appeals Council

  • Suit against the Social Security Administration in Federal District Court


Each of these options require certain filings with the Social Security Administration and those filings must be done within certain time limits.
 

Also, each different type of appeal will require different types of proof as to why the previous decision of denial is incorrect.
